Since the majority of U.S. expats will be official residents of their host country, they will be exempt under American Obamacare laws. However, they must prove they are not a resident of the U.S., which can be done by completing two tests: the Bona Fide Residence Test and the Physical Presence Test.
The Bona Fide Residence Test: To qualify for this requirement, you will have to prove that you have been living abroad for at least one year and have no immediate plans to return to the United States.
The Physical Presence Test: You will meet this test requirement if you have earned an income in your host country within the past year, and have been physically out of the U.S. for 330 days out of a 365 day period.
Once you have completed the criteria for both tests, you will be considered exempt from Obamacare, but will only be provided with the minimum essential coverage, meaning you must sign up for a global insurance program.
